Terms of Service

1. Agreement to Terms
By accessing or using the Touringuide Australia website (“touringuide.com”), mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not access or use the Service.
These Terms constitute a legally binding agreement between you (“you” or “User”) and Touringuide (“we”, “us”, or “our”). We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.
2. Eligibility
You must be at least 18 years of age to create an account or purchase a subscription. By using the Service, you represent and warrant that you meet this age requirement. Minors under 18 may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.
3. User Accounts
To access certain features, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Ensuring your account information remains accurate and up-to-date
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period, with reasonable notice where possible.
4. Subscription Plans & Payments
4.1 Available Plans
The Service offers the following subscription tiers:
- Free — $0/month. Limited trip planning (2 trips, 5 stops per trip), browse all listings, basic tools, email support.
- Plus — $4.99 AUD/month. Unlimited trips (50 stops per trip), AI Trip Planner, weather warnings, exclusive deals, ferry and flight integration, priority email support.
- Pro — $14.99 AUD/month. Everything in Plus, plus unlimited stops per trip, AI Booking Agent, AI Trip Manager, in-app messaging, trip exports (PDF/Excel), ferry quotes.
- Ultimate — $79 AUD/month. Everything in Pro, plus dedicated human concierge team, all bookings handled on your behalf, emergency support, insurance management, pre-trip checklists, on-trip check-ins. Requires a minimum 12-month commitment.
All prices are in Australian Dollars (AUD) and inclusive of GST where applicable. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
4.2 Billing & Payment
Paid subscriptions are billed monthly in advance via Stripe, our third-party payment processor. By subscribing, you authorise us to charge your designated payment method on a recurring monthly basis until you cancel. All payment processing is handled by Stripe — we do not store your full credit card details on our servers.
4.3 Ultimate Plan Commitment
The Ultimate plan requires a minimum 12-month commitment. You may not downgrade or cancel the Ultimate plan during the commitment period. After the 12-month commitment, the plan will continue on a month-to-month basis and may be cancelled at any time with effect at the end of the then-current billing period.
4.4 Cancellation & Downgrades
You may cancel or downgrade your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. No partial refunds are given for unused portions of a billing period, except where required by Australian Consumer Law.
4.5 Failed Payments
If a payment fails, we may retry the charge and/or notify you to update your payment method. Continued failure may result in downgrade to the Free tier. We are not liable for any loss of data or access resulting from payment failure.
4.6 Refund Policy
Subscriptions are generally non-refundable. However, we honour all rights under the Australian Consumer Law. If you believe you are entitled to a refund, please contact us at support@touringuide.com. Refund requests will be assessed on a case-by-case basis.
5. Advertising
Free tier users may see advertisements served by Google AdSense and other third-party advertising networks. Paid subscribers (Plus, Pro, and Ultimate) receive an ad-free experience. We may display affiliate links and partner promotions across all tiers; these will be clearly identified where required by law.
6. AI-Powered Features
Certain features of the Service use artificial intelligence, including the AI Trip Planner, AI Booking Agent, and AI Trip Manager. You acknowledge that:
- AI-generated suggestions, routes, and recommendations are provided as guidance only and should not be relied upon as the sole source of travel planning information
- AI outputs may contain inaccuracies, and you are responsible for verifying all information before acting on it
- We do not guarantee the availability, accuracy, or suitability of AI-generated content for any purpose
- Your interactions with AI features may be logged for quality improvement and service monitoring purposes
7. Concierge Services (Ultimate Plan)
Ultimate plan subscribers receive access to a dedicated human concierge team. You acknowledge that:
- Concierge services are provided on a best-efforts basis and response times may vary
- We act as a facilitator for bookings and services — we are not the direct provider of accommodation, transport, insurance, or emergency services
- Emergency support provides coordination assistance only and is not a substitute for calling 000 (Triple Zero) or other emergency services
- Insurance management involves coordination on your behalf — we do not provide insurance products or financial advice
- All bookings made by the concierge team on your behalf are subject to the terms and conditions of the respective service provider
8. User Content
You may submit content to the Service including trip data, reviews, community posts, photos, and other materials (“User Content”). By submitting User Content, you:
- Retain ownership of your User Content
- Grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, modify, and distribute your User Content in connection with operating and improving the Service
- Represent that you have the right to submit such content and that it does not violate any third party's rights
- Agree not to submit content that is illegal, defamatory, harassing, obscene, fraudulent, or otherwise objectionable
We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.
9. Marketplace & Listings
The Service includes marketplace features for caravans, vehicles, and camping gear. Touringuide acts as a platform connecting buyers and sellers — we are not a party to any transaction between users. We do not:
- Guarantee the accuracy of any listing information
- Warrant the condition, quality, or legality of items listed
- Assume responsibility for the completion of any transaction
- Provide buyer or seller protection beyond what is required by law
Users are responsible for conducting their own due diligence before entering into any transaction.
10. Listing Data & Third-Party Information
The Service aggregates and displays information about campsites, trails, attractions, fuel stations, toilets, dump points, pubs, services, and other points of interest across Australia. This data is sourced from public records, government datasets, third-party providers, and user contributions. We make reasonable efforts to keep this information current but do not guarantee its accuracy, completeness, or timeliness.
Always verify critical information (such as campsite availability, trail conditions, road closures, fuel prices, and opening hours) directly with the relevant authority or provider before relying on it.
11. Referral & Affiliate Programs
We may offer referral programs that reward users for referring new subscribers. Referral credits and rewards are subject to separate program terms and may be modified or discontinued at any time. Abuse of referral programs (including self-referral, fake accounts, or spam) will result in forfeiture of rewards and may lead to account suspension.
The Service may contain affiliate links to third-party products and services (including travel bookings via partner platforms). We may earn commissions from qualifying purchases. Affiliate relationships do not influence our editorial content or recommendations.
12. Intellectual Property
The Service, including its design, code, text, graphics, logos, icons, and software, is owned by or licensed to Touringuide and is protected by Australian and international intellectual property laws. You may not:
- Copy, modify, or distribute any part of the Service without our written consent
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to build a competing product or service
- Scrape, crawl, or systematically extract data from the Service beyond what is permitted by our robots.txt
13. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to any part of the Service
- Use automated systems (bots, spiders, scrapers) to access the Service without our consent
- Upload malware, viruses, or harmful code
- Harass, abuse, or threaten other users
- Create multiple accounts to circumvent subscription limits or abuse free tier features
- Share your account credentials with others or allow third parties to use your account
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any information obtained through the Service.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
15. Limitation of Liability
To the maximum extent permitted by law, Touringuide and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service
- Any reliance on information, routes, or recommendations provided by the Service (including AI-generated content)
- Unauthorised access to or alteration of your data
- Actions or omissions of third-party service providers, including booking providers, campsite operators, and emergency services
- Service interruptions, data loss, or technical failures
Our total aggregate liability for all claims arising from your use of the Service shall not exceed the greater of (a) the amounts you have paid to us in the 12 months preceding the claim, or (b) $100 AUD.
16. Indemnification
You agree to indemnify, defend, and hold harmless Touringuide and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
17. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may delete your account at any time by contacting us at support@touringuide.com.
Upon termination: (a) your right to use the Service ceases immediately; (b) any active paid subscription will be cancelled (subject to the Ultimate commitment terms in Section 4.3); (c) we may delete your account data after a reasonable retention period, subject to our Privacy Policy.
18. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us at support@touringuide.com. We will endeavour to resolve complaints within 30 days.
19. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
20. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Touringuide regarding your use of the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, government actions, or internet outages.
